By cutting overheads – such as branch offices and those fancy German cars (that most agents have but you don’t), much of the commission goes back to the buyer at a time when they sure could do with the money – need help with that kitchen or bathroom upgrade? Your rebate check could cover it.

How does the rebate work and is it permitted by law?

Rebate Structure: I retain only 50% of the buyer agent commission and pass the rest, less a small administrative fee of $500, back to my clients.

The fee that I retain is based on a 3% listing and will remain the same in the case of a 2.5% listing.

Legality: Both California law and Federal law permit commission sharing with the buyer. The Federal Real Estate Settlement Procedures Act of 1974 12 U.S.C. 2601 et seq.; 42 U.S.C. 3535(d), more commonly known as RESPA, specifically mentions commission sharing with buyer clients as an exception to the RESPA restrictions on rebates.
